Canada Identifies Those Who Need Authorization to Re-Enter After a Deportation Order

Canada’s immigration rules specify whether a person who has received a removal order must first acquire an Authorization to Return to Canada (ARC) before legally reentering the country.
Two major considerations determine whether an ARC is required: the type of removal order issued and whether the impacted person cooperated with the order’s requirements.
Individuals who do not fit the standards must apply for an ARC before attempting to return.
There is one major exception. If a person was deported from Canada only for accompanying a family member who was the subject of a deportation order, they do not need to acquire an ARC to reenter the country.
Admissibility remains unchanged. Simply holding or acquiring an ARC does not guarantee entry into Canada. Regardless of ARC status, any person attempting to return must be accepted under Canadian immigration rules.
The admissibility determination is made in two steps. When someone applies for a visa or an electronic travel authorization, a Canadian immigration officer analyzes their application.
When a person comes to Canada or passes through the port of entry, a border services officer makes a separate decision in transit.
Canada: Three steps in the ARC process
Canada’s immigration guidelines divide the ARC procedure into three basic categories.
- The first step is to determine who needs one. This includes analyzing the sort of removal order obtained to determine whether an ARC is required at all.
- The second section addresses pre-application considerations. Applicants should consider whether their personal circumstances have changed since the removal order was issued and calculate the cost of filing an application.
- The third section explains how to apply, including how to complete and submit your application to the appropriate Canadian immigration authorities. People who have received a removal order from Canada and want to return should carefully consider which sort of order relates to their situation before taking any measures toward re-entry.
