Court issues order, bars Rivers CJ from acting on Assembly’s impeachment request

A Rivers State High Court sitting in Port Harcourt has halted moves linked to the planned impeachment of Governor Siminalayi Fubara and his deputy, Professor Ngozi Nma Odu.
The court stopped the Chief Judge of Rivers State, Justice Simeon Chibuzor Amadi, from receiving or acting on any impeachment-related communication from the State House of Assembly.
Court Issues Interim Injunction
The ruling followed two separate suits filed by Governor Fubara and his deputy at the High Court in Oyibo Local Government Area.
The cases were marked Suit No. OYHC/7/CS/2026 and Suit No. OYHC/6/CS/2026 respectively.
Justice F. A. Fiberesima, who presided over the matter, granted interim injunctions restraining the Speaker, Martin Amaewhule, and 32 others from proceeding with impeachment steps.
Those restrained include members of the Assembly, the Clerk of the House, and the Chief Judge of the state.
Restrictions Placed on Chief Judge
The court specifically barred Justice Amadi from receiving, considering, or acting on any impeachment notice or request for seven days.
This includes any resolution or communication aimed at forming a panel to investigate alleged misconduct against the governor and his deputy.
Service of Court Orders Approved
Justice Fiberesima allowed the claimants to serve court papers on the first 31 defendants by pasting them at the Rivers State House of Assembly Quarters.
The Chief Judge, listed as the 32nd defendant, is to be served through any judiciary staff at his chambers within the High Court premises.
Case Adjourned
The court adjourned the matter to January 23, 2026, for the hearing of the motion on notice.
